STATUTE

OF CROATIAN VETERINARY CHAMBER

I. GENERAL TERMS

Article 1.

By this Statute the organization, tasks and activities of Croatian Veterinary Chamber are established as well as the way of acting, the means and assets for carrying out its tasks, the matters of membership, the managing bodies, the way of their electing and their acting, recalling, mandate, decision making and responsibilities of the bodies, agency and representing, defensive tasks and social controlling and all other questions decisive for the activities of Croatian Veterinary Chamber.

 

Article 2.

Croatian Veterinary Chamber (hereinafter called: the Chamber) is a professional association of veterinary class consisting of graduated veterinarians (doctors of veterinary medicine) with or without the right of acting in public.

The members of the Chamber may be the retired veterinarians as well as foreign citizens graduated veterinarians having or not having the residence in the territory of the Republic of Croatia.

Article 3.

The Chamber is a legal person with all the rights, liabilities and responsibilities entitled to by the Constitution and the Law, registered in the Register of Associations and acting in the territory of the Republic of Croatia.

In accordance with the needs and the conditions and on the suggestion of the Executive Committee, the Chamber may establish its subsidiaries for particular districts or one subsidiary for several districts.

Article 4.

The Chamber makes decisions on collaboration with other veterinary chambers, making contacts with similar institutions and on cessation of such collaboration autonomously.

The Chamber may collaborate with corresponding international organizations and become a member of such organizations.

The decisions on becoming the member are to be made by the Executive Committee.

II. NAME, HEADQUARTERS AND SPHERE OF ACTION

Article 5.

The name of the Chamber reads as follows: Croatian Veterinary Chamber. The shortened name of the Chamber is: CVC Zagreb.

Article 6.

The headquarters of the Chamber is in Zagreb, Planinska Street 2b.

Article 7.

The Chamber acts in the whole territory of the Republic of Croatia.

Article 8.

The Chamber has its logotype. The visual solution of the logo is enclosed to the Statute being its constitutional part.

The Chamber has its seal and stamp and a stamp with the coat of arms of the Republic of Croatia.

The seal and the stamp of the Chamber are round, 30 mm in diameter with the following text written in the circle: Croatian Veterinary Chamber - Zagreb, and in the middle there is the logo of the Chamber.

The seal of the Chamber is rectangular, 60-20 mm of size, containing the name and the address of the Chamber’s headquarters.

According to Article 2. of the Act on Seals and Stamps of the Republic of Croatia, the stamp of the Chamber with the coat of arms of the Republic of Croatia is round, 25 and 38 mm in diameter and comprising in the middle of the stamp in concentric circles around the coat of arms of the Republic of Croatia the text “The Republic of Croatia? written above the coat of arms with the letters bigger than those in the rest of the text, and under the coat of arms the text “Croatian Veterinary Chamber” with the residence of the legal person Zagreb and the number of the stamp written in.

The stamp of the Chamber with the coat of arms of the Republic of Croatia is used exclusively on the documents passed by Croatian Veterinary Chamber in the scope of public authorities.

Article 9.

The decisions on changing the name, headquarters, the sphere of action, number and the way of use of the seal and stamp are made by the body specified by the Statute.

 

III. PURPOSE OF ESTABLISHING, GOALS AND TASKS

Article 10.

In accordance with the Act the Chamber:

- protects and represents the interests of veterinarians, takes care of the reputation and discipline in veterinary class,

- formulates the Codex of Veterinary Profession by which the principles and rules are established and which are to be regarded by veterinarians in their work,

- takes care that veterinarians act professionally and responsibly,

- follows and considers the problems of veterinary class,

- participates in supervising the professional work in carrying out veterinary activities,

- takes care of the concordant development and improvement of veterinary class,

- collaborates with national authorities, with Croatian University and other institutions to provide efficacious work of veterinarians in the society and to represent and protect their interests,

- chooses prominent experts and appoints them the counsellors of the Chamber,

- keeps the register of veterinarians,

- plans and supervises systematic and continuous professional improvement of its members,

- together with the Ministry of Agriculture and Forestry, the University and the Veterinary Faculty participates in making programmes for under- and postgraduate studies as well as for continuous education,

- carries out the jobs and tasks entrusted by the Ministry of Agriculture and Forestry, according to the Act on Veterinary (National Gazette no. 70/97),

- establishes the responsibility of veterinarians in breaking the Codex of Veterinary Ethics, the Statute of the Chamber and other rules and regulations,

- takes care of the realization of legal protection of veterinarians,

- takes care of material and other interests of the members and retired veterinarians,

- helps the families of handicapped, ill or dead members,

- collaborates in programming the development of veterinary medicine and service and in improving the unique system of animal health care and veterinary service,

- proposes the prices for the services and specifies the minimal price of work of a graduated veterinarian,

- follows and improves the business operations of legal and physical persons performing the tasks of animal health care and veterinary service,

- gives veterinarians the licences, prolongs and withdraws them,

- organizes professional meetings,

- publishes journals, bulletins, professional publications and different forms,

- coordinates the work of its subsidiaries,

- establishes professional departments according to the branches of veterinary activity,

- establishes and supervises the way of launching veterinary organizations and private practice,

- performs also other tasks specified by the Statute and the enactments of the Chamber.

Article 11.

The Chamber constitutes Committees which enable the performing of Chamber’s tasks.

The Committees make the bylaws specifying the sphere and the way of their action.

The bylaws of the Committees are to be accepted by the Chamber’s Assembly.

Article 12.

The activity of the Chamber is open to public. The publicity of the Chamber’s work is achieved according to the Statute’s provisions and the enactments of the Chamber.

 

IV. MEANS AND ASSETS

Article 13.

The assets needed for the work of the Chamber are collected by:

- a registration fee, membership subscription and contributions of the Chamber’s members,

- incomes from the compensations for the services performed by the Chamber,

- incomes from holding congresses, symposia and conferences,

- incomes from professional and scientific services,

- incomes from its own publishing,

- other incomes.

Article 14.

The Chamber calculates the means and assets needed for the work of the Chamber by the annual financial plan based on the anticipated costs for carrying out the tasks from the programme of the Chamber’s work, the costs for the work of the Chamber’s bodies, technical services of the Chamber and other current jobs.

The financial plan and its revision are made by the Assembly on the preposition of the Executive Committee.

Article 15.

The finances of the Chamber are carried out as regulated by the Law and other regulations based on the Law, the Statute and the enactments of the Chamber.

Article 16.

The Chamber operates with a unique transfer account.

V. CHAMBER’S BODIES

Article 17.

The Chamber’s bodies are the following:

- Chamber’s Assembly

- President of the Chamber

- Chamber’s Executive Committee

- Administrative Committee

- Committee for Veterinary Ethics

- Disciplinary Board

- Chamber’s Attorney (Defence Counsel)

- Committee for Professional Improvement of Veterinarians

- Technical Committee

- Committee of Economics

- Supervisory Board

- Publishing Committee

- other committees and boards established by the Assembly.

CHAMBER’S ASSEMBLY

Article 18.

The Assembly is the supreme managerial body of the Chamber.

The Assembly consists of the members elected by particular subsidiaries as their representatives.

Article 19.

The Chamber’s Assembly takes care of carrying out the tasks specified by the Statute and the Act on Veterinary and in addition it:

- makes all basic guidelines for the programme of the Chamber’s work,

- passes the Chamber’s Statute on the basis of the accordance with the Ministry of Agriculture and Forestry,

- passes the Codex of Veterinary Ethics,

- passes also other bylaws important for the Chamber’s activity,

- takes care of the concordant and continuous development of veterinary service,

- discusses and considers the matters concerning the position and status of veterinary workers in the society,

- makes decisions on becoming the member of an international organization and on membership termination,

- takes care of the improvement of the material conditions of veterinary workers,

- elects the president, three vice-presidents and the members of other bodies of the Chamber,

- discusses and makes attitudes, conclusions and instructions on current matters being solved,

- considers and accepts the reports on the work of the committees,

- accepts the reports on finances and the annual financial statement,

- accepts annual calculations of the Chamber,

- brings the unique standards and normative provisions on work,

- makes decisions on founding and cancellation of the subsidiaries of the Chamber and its technical boards,

- passes the Bye-Law on the work of the Assembly,

- makes decisions on awarding and acknowledging the members,

- proposes the meritorious members for decorations and public acknowledgements,

- makes decision on cessation of work of the Chamber,

- discusses the conclusions and brings resolutions on all other matters and proposals being in the sphere of action of the Assembly and according to legal regulations and the Statute of the Chamber.

Article 20.

The Assembly is in session according to the needs and at least once a year. The sessions of the Assembly are convened by the President on his own initiative or if demanded by at least one third of the representatives or at least two subsidiaries.

The President must convene the Assembly 30 days after receiving the demand as the latest and if he fails to do so, the Assembly can be convened by the proposers themselves.

Article 21.

The summons for the session of the Assembly should be delivered to the representatives 10 days before the session as the latest.

In the summons the place, day and hour and the agenda of the session should be stated. The presence of the majority of the Assembly members is obligatory for a quorum.

All the decisions are made by a majority vote of the present Assembly members (given votes), except the decision on passing the Statute, which is to be reached by two-thirds majority as a qualified majority.

The way of work is specified by the Bye-Law of the Assembly.

On the Assembly minutes should be taken, which is to be kept as a document of permanent value.

Article 22.

Each subsidiary elects five representatives for the Chamber’s Assembly and one more to 25 veterinarians in a particular subsidiary. As a rule, the elections of the Assembly members and the members of the Assembly organs are direct and carried out by open or secret ballot according to the decision of the Assembly or the Assembly’s body.

Article 23.

The candidates for the president, three vice-presidents and the members of the Chamber’s committees are proposed by the Assembly members at the session.

The list of candidates is to be approved by the Assembly by the majority of votes of the present members. The number of the registered candidates can be larger than the number of candidates that are to be elected.

Article 24.

The Assembly elects the president, three vice-presidents and the members of the committees at the Assembly session by the majority of votes of the members present, by open or a secret ballot.

Article 25.

The mandate of the Assembly members, the president, three vice-presidents, the Executive Committee and technical boards lasts for four years.

Article 26.

The Assembly has the right to release the members of the Chamber’s bodies being elected even before expiration of the mandate and to immediately elect new members under the conditions specified by the Law and the Statute.

When the mandate of the member of the Chamber’s body expires the Assembly shall elect a new member instead of him at the first following session.

PRESIDENT OF THE CHAMBER

Article 27.

The Chamber’s President:

- represents the Chamber,

- carries out the resolutions reached by the Executive Committee,

- runs the sessions of the Chamber’s Executive Committee,

- signs the Chamber’s contracts,

- is a cosignatory of all the documents of the Secretary and the Treasurer,

- in emergency acts in the matters otherwise belonging to the sphere of action of the Chamber’s Executive Committee, about which he informs the Chamber’s Executive Committee,

- makes decision on initiating a disciplinary procedure or authorizes a person for initiating a disciplinary procedure in the case of violating the Statute, Codex of Veterinary Ethics or other regulations of the Chamber and if irregularities in carrying out veterinary activities occur,

- proposes the cessation of a disciplinary procedure,

- is entitled to lodge complaints and to initiate appropriate legal proceedings,

- signs contracts on employment with the Chamber,

- carries out other tasks according to the Chamber’s enactments.

The President is responsible for his work to the Chamber’s Assembly.

In the absence of the Chamber’s President a Chamber’s vice-president or a member of the Executive Committee is deputized for his job by the decision of the Executive Committee.

EXECUTIVE COMMITTEE OF THE CHAMBER

Article 28.

The Executive Committee operationally runs the work of the Chamber.

The Executive Committee consists of: the president, three vice-presidents, the secretary, two representatives of the Ministry of Agriculture, a representative of Veterinary Faculty, the presidents of the Chamber’s subsidiaries and the presidents of the Chamber’s committees (except the Supervisory Board).

The members of the Executive Committee from the Ministry of Agriculture and Forestry and Veterinary Faculty are proposed by the president of CVC in agreement with the Ministry of Agriculture and Forestry and the Veterinary Faculty.

The President of the Chamber is at the same time also the president of the Executive Committee.

Article 29.

The tasks of the Executive Committee of the Chamber are the following:

- to prepare the materials for the session of the Assembly,

- to carry out the resolutions and instructions of the Assembly,

- to discuss and conclude on veterinary matters,

- to collaborate with the Ministry of Agriculture and Forestry, the Ministry of Education and Sports, the Ministry of Health, the Ministry of Science and Technology, the Veterinary Faculty, the Croatian Veterinary Institute and other interested institutions,

- to discuss the conclusions and resolutions and to adopt the conclusions on the reports of the Chamber’s committees,

- to prepare the drafts of the Statute, Codex and other enactments of the Chamber,

- to resolve complaints at the second degree,

- to appoint the Secretary of the Chamber and employ him/her,

- to appoint the Counsellor of the Chamber,

- to run the finances and manage the assets of the Chamber,

- to employ other collaborators of the Chamber,

- to pass the enactments needed for the work of the Chamber’s technical services,

- to decide on the amount of the membership subscription and other membership obligations,

- to carry out other tasks in accordance with the Statute and other documents of the Chamber.

Article 30.

The sessions of the Executive Committee are convened by the President of the Chamber.

The quorum is obtained with the presence of the members’ majority.

The decisions are made with the majority vote of the present members.

The Executive Committee is responsible for its work to the Chamber’s Assembly.

The work of the Executive Committee is specified by the By-Law.

The decisions of the Executive Committee are signed by the President or the authorized member of the Executive Committee.

On the work of the Executive Committee the minutes should be taken.

ADMINISTRATIVE COMMITTEE

Article 31.

Administrative Committee is the body of the Chamber which takes care of the registration of the members in accordance with the Statute of the Chamber and of issuing veterinary documentation according to the programme.

Administrative Committee has five members, one being appointed by the Ministry of Agriculture and Forestry and four being elected by the Chamber’s Assembly.

The mandate of the Committee’s members is four years.

The President of the Committee is responsible for his work and gives a report on the work to the Executive Committee and the Chamber’s Assembly and once a year he prepares the information for the Chamber’s Assembly.

Article 32.

The tasks of the Administrative Committee are the following:

- to analyse the criteria for getting the previous opinion for founding veterinary organizations, private practice and veterinary services by a special document, according to the network of veterinary organizations, private practice and veterinary services needed,

- to make decisions on giving the opinion from the previous paragraph on the basis of the criteria from the previous paragraph,

- to establish whether a veterinarian meets the requirements needed for carrying out veterinary service,

- to supervise the Register and personal lists of the Chamber’s members,

- to receive and review the applications and remarks of veterinarians at registering into the Register and in the personal lists of veterinarians,

- to organize the issuing of official veterinary documentation in the Republic of Croatia on the basis of the authorization of the Minister from the Ministry of Agriculture and Forestry,

- to organize the issuing of other unique veterinary documentation in the Republic of Croatia.

COMMITTEE FOR VETERINARY ETHICS

Article 33.

The Committee for Veterinary Ethics is a professional body of the Chamber which discusses, announces, interprets and advises in the matters concerning the Codex of Veterinary Ethics. It is independent in its work and acts according to the Act, Codex and the Statute of the Chamber.

The Committee consists of the president and four members. The mandate of the Committee members is four years. The President of the Committee is elected by the members among themselves.

Article 34.

The tasks of the Committee for Veterinary Ethics are the following:

- to pass the Bylaw on launching and the way of announcing the work of veterinary organizations and private practice,

- to establish the violation of the Codex and propose sanctions to the Chamber’s bodies,

- to consider and establish the jeopardizing of the reputation of veterinary class and concerning this take attitudes and propose the procedure to the authorized bodies of the Chamber,

- to judge, approve or reject the proposals for the research regarding the relevant international provisions,

- to carry out other jobs specified by the Codex of Veterinary Ethics.

Article 35.

The Committee reaches decisions by the majority of votes and its attitudes, recommendations and conclusions are to be made in writing.

The member of the Committee who worked on the case cannot vote on that particular case. The Committee is responsible for its work to the Chamber’s Assembly.

Article 36.

The member of the Chamber disagreeing with the attitudes and the decisions of the Committee for Veterinary Ethics may complain to the Executive Committee of the Chamber.

After a thorough reconsidering and a discussion, the Executive Committee of the Chamber may return the case to the Committee for Veterinary Ethics demanding its revision.

DISCIPLINARY BOARD

Article 37.

The Disciplinary Board is the Chamber’s body which decides on the responsibility of veterinarians in violating the rules and regulations on carrying out veterinary profession, and the provisions of the Statute, respectively.

The members of the Executive Committee cannot be the members of the Disciplinary Board.

The Disciplinary Board has a president and four members and the same number of deputies. The President of the Board is elected by the members of the Board among them.

The mandate of the Board’s members lasts for four years.

Article 38.

Nobody can be summoned to the Disciplinary Board because of his political views.

Article 39.

The tasks of the Disciplinary Board are the following:

- to propose the By-Law on the Work of the Disciplinary Board and the By-Law on the Disciplinary Procedure,

- to investigate and decide on the irregularities in carrying out veterinary activities and on the proposal of the Chamber’s President, individual veterinarians or a group of veterinarians, veterinary or other physical or legal person or body of the Chamber and the authorities of the national administration,

- to make decisions on breaking the provisions of the Statute, the Codex of Veterinary Ethics and other By-Laws of the Chamber,

- to carry out other jobs and tasks specified by the Statute, the By-Law on the Work of the Disciplinary Board and the By-Law on the Disciplinary Procedure.

The Disciplinary Board makes decisions by the majority votes and reaches its decisions in writing.

Article 40.

The procedure of establishing the responsibility is initiated on the request of the Chamber’s Attorney.

For carrying out the procedure the Disciplinary Board may appoint an investigative commission.

The counsellors of the Chamber or other members of the Chamber can be appointed to the members of the Commission.

The member of the Commission who ran the investigation cannot decide on the infringement.

Article 41.

For the infringements established by the Statute - the Disciplinary Board pronounces a caution, a reprimand, a fine or a ban on carrying out veterinary activities for a definite period of time and about that informs the authorized body of the national administration.

Article 42.

On the decisions of the Disciplinary Board a complaint can be lodged to the Executive Committee of the Chamber.

The Executive Committee of the Chamber clears out the complaints at the second degree. On the decisions of the Executive Committee of the Chamber there is no possibility of lodging a legal recourse.

Article 43.

The Disciplinary Board is responsible for its work and gives reports on its work to the Assembly and the Executive Committee of the Chamber.

 

Concerning the procedure of the Disciplinary Board the provisions on criminal proceedings are applied in the appropriate manner.

CHAMBER’S ATTORNEY

Article 44.

The Attorney is the Chamber’s body and its duty, right and obligation is to represent the interests of the accused in a disciplinary procedure.

The Attorney is elected by the Assembly of the Chamber.

The deputy of the Attorney is elected in the same way.

The Attorney of the Chamber can be any member of the Chamber or a lawyer chosen by the accused.

The mandate of the appointed Attorney and his deputy lasts for four years.

COMMITTEE FOR PROFESSIONAL IMPROVEMENT OF VETERINARIANS

Article 45.

The Committee for Professional Improvement of Veterinarians is a Chamber’s body which takes care of the improvement of professional education, according to the provisions of the By-Law on the Professional Improvement of Veterinarians.

Article 46.

In organizing and carrying out its tasks the Committee collaborates with the Ministry of Agriculture and Forestry, the Ministry of Education and Sports, the Veterinary Faculty, the Croatian Veterinary Institute and other institutions.

Article 47.

The tasks of the Committee for Professional Improvement are the following:

- to plan and give programmes for professional improvement of veterinarians,

- to follow and control professional improvement of veterinarians,

- to pass the By-Law on periodic verifying the knowledge of veterinarians,

- to organize testing of veterinarians’ knowledge,

- to issue certificates after the tests being carried out concerning the issuing of the licences for performing veterinary activities during a certain period,

- to keep records on professional improvement,

- to carry out other professional tasks for the needs of the Chamber.

Article 48.

The Committee for Professional Improvement is led by the Board consisting of five members appointed by the Assembly. They elect the president among themselves.

The mandate of the Board and the president is four years.

 

Article 49.

The Committee gives reports to the Executive Committee of the Chamber and is responsible for its activities to the Executive Committee of the Chamber.

Once a year it prepares a report for the Chamber’s Assembly.

TECHNICAL COMMITTEE

Article 50.

The Technical Committee is the Chamber’s body which adjusts professional interests and attitudes of the Chamber to the Veterinary Faculty, the Ministry of Agriculture and Forestry, the Croatian Veterinary Institute and other institutions for a better improvement of the professional level of veterinary service in the Republic of Croatia.

Article 51.

The Technical Committee has seven members consisting of a member from the Ministry of Agriculture and Forestry, a member from the Veterinary Faculty and a member from the Croatian Veterinary Institute. The President of the Committee and three other members are appointed by the Executive Committee of the Chamber apart from veterinary practitioners.

The mandate of the Technical Committee is four years.

Article 52.

The tasks of the Technical Committee are as follows:

- to plan and propose the network of the needed veterinary organizations, private practice and veterinary service in particular regions of the Republic of Croatia,

- to plan the number of veterinarians and specialists needed in the Republic and their territorial distribution,

- tp give and prolong the licences for the work of veterinarians,

- to give proposals in adopting legal, sub-legal and other documents from the field of veterinary service and its functioning,

- to give proposals for making the standards and normative provisions of veterinary activities,

- to participate in making programmes for undergraduating and postgraduating studies together with the Veterinary Faculty and other institutions,

- to participate in other tasks being specified.

Article 53.

The President of the Technical Committee is responsible to and gives reports to the Executive Committee of the Chamber. Once a year it submits a report to the Assembly of the Chamber.

COMMITTEE OF ECONOMICS

Article 54.

The Committee of Economics has five members elected by the Chamber’s Assembly. If needed, it also includes the experts in the economy, legal experts or others in its work.

The President of the Committee is elected by the members among themselves.

The mandate of the members of the Committee is four years.

Article 55.

The tasks of the Committee of Economics are as follows:

- to protect the material interests of its members,

- to suggest the amount of membership subscriptions and other dues to the Chamber,

- to make the criteria for evaluating the work of veterinarians,

- to decide on minimal prices of the work of veterinarians,

- to give proposals on the price list of veterinary services according to the nomenclature,

- to prepare the proposals for financing veterinary activities,

- to prepare the proposals for financing the activities of the Chamber other than subscriptions (donations),

- to carry out the adopted resolutions on financing the Chamber,

- to consider the regulations from the field of financing veterinary service,

- to participate in proposing the financing of the veterinary activities being financed from the Budget of the Republic of Croatia,

- to analyse the economic status of veterinary service and veterinary class regularly.

Article 56.

The President of the Committee of Economics is responsible to the Executive Committee. Once a year he submits a report to the Assembly of the Chamber.

SUPERVISORY BOARD

Article 57.

The Supervisory Board consists of five members elected by the Chamber’s Assembly. The members of the Board elect its president among themselves.

The mandate of the members of the Board is four years.

The Supervisory Board is directly responsible to the Assembly and the President of the Chamber. It submits the report to the Assembly at least once a year.

The members of the Executive Committee or other committees or boards of the Chamber cannot be elected to the Supervisory Board.

Article 58.

The Supervisory Board has the following tasks:

- to supervise the carrying out of the Statute and other enactments of the Chamber,

- to supervise the material business operations of the Chamber,

- to supervise the financial and treasury transactions of the Chamber,

- to supervise the books and documents related to the resources and the assets of the Chamber,

- to carry out other supervisory jobs according to the decision of the Assembly.

PUBLISHING COMMITTEE

Article 59.

The Publishing Committee organizes:

- the publishing of professional, scientific and popular issues, manuals and forms from the field of veterinary,

- the publishing of the journal in which all the documents of the Chamber are published, the reports on the activities of the Chamber and its bodies given as well as those on the work of subsidiaries and departments,

- the publishing of other journals and bulletins from the field of veterinary according to the needs,

  • it carries out other publishing jobs and tasks being specified by the Assembly, the Executive Committee and the Administrative Committee on the basis of the special authority of the Ministry of Agriculture and Forestry.

Article 60.

The Publishing Committee consists of five members appointed by the Assembly. They elect their president among themselves.

The mandate of the members of the Committee lasts for four years.

Article 61.

The work of the Publishing Committee is determined by the By-Law on the publishing activity. The Committee acts in accordance with the law and it is responsible for its work to the Assembly of the Chamber, to which it submits a report at least once a year.

VI. MEMBERSHIP

GETTING THE LICENCE FOR CARRYING OUT VETERINARY ACTIVITIES

Article 62.

The members of the Chamber are all graduated veterinarians (doctors of veterinary medicine) carrying out veterinary jobs in the territory of the Republic of Croatia in accordance with the Act and the Statute of the Chamber.

Article 63.

The status of the Chamber’s member is got by registering in the membership records, and under the following conditions:

- that a candidate is a graduated veterinarian (doctor of veterinary medicine) or that he has got a validated diploma,

- that he acts in the territory of the Republic of Croatia,

- that by a court resolution or by a resolution of another authority no ban on carrying out veterinary jobs has been put to him.

Article 64.

In the Republic of Croatia animal health protection and veterinary service can be carried out only by a person with the licence (work permit) issued by Croatian Veterinary Chamber.

The licence for carrying out the activities is obtained under the conditions specified by the By-Law of the Ministry of Agriculture and Forestry:

- graduating at the Veterinary Faculty and gaining the title of a graduated veterinarian (doctor of veterinary medicine) or validation of a diploma,

- passing a professional exam regulated by the By-Law on Professional Improvement of Veterinarians,

- meeting the general conditions for the employment,

- proficiency in Croatian language,

- membership in Croatian Veterinary Chamber.

Article 65.

Veterinarians carrying out animal health protection and veterinary service should be registered in the Register of Veterinarians of the Republic of Croatia.

The way of registering the veterinarians into the Register from the previous paragraph comes within the competence of the Chamber’s Administrative Committee.

TEMPORARY BAN, DEDUCTION OR CESSATION OF LICENCE

Article 66.

The Disciplinary Board of the Chamber can temporarily deduct the licence from a veterinarian, but not for longer than 6 months - if a violation of the Statute, the Codex of Veterinary Ethics or other regulations has been established by a disciplinary procedure.

In the most serious cases of violation of the Statute, the Codex of Veterinary Ethics or other regulations and evidenced felonies the Disciplinary Board of the Chamber can deduct the licence from a veterinarian for a longer period of time or permanently.

Article 67.

The licence of a veterinarian is ceased by:

- own renouncing of carrying out veterinary jobs,

- failing to prolong the work permit (licence),

- establishing that one meets the conditions specified by the Act no more,

- suspending one’s Chamber’s membership,

- deducting the work permit.

The forfeit to carry out veterinary jobs is determined by the Executive Committee.

RIGHTS AND LIABILITIES OF VETERINARIANS

Article 68.

Once registered in the Register of the Veterinarians of the Republic of Croatia a veterinarian gains the rights and liabilities by the Law, this Statute and the Codex of Veterinary Ethics.

Article 69.

A veterinarian is obliged to inform the Chamber on: his removal or a change of his employer or his gaining the higher degree of qualifications.

The management of veterinary institutions or associations is obliged to inform the Chamber on the changes which are kept in the Register of Veterinarians.

Article 70.

A veterinarian, the owner of a private practice and veterinary service who moves his activity in the new premises should inform the Chamber on his removal 30 days prior to the removal.

Before the beginning of his work he is obliged to submit to the Chamber the evidence on meeting the conditions of supervisory organs for carrying out the related veterinary activities.

Article 71.

The member of the Chamber is obliged to pay the subscription dues and other duties defined (set) by the Executive Committee and the Assembly of the Chamber.

Article 72.

A veterinarian must have his own stamp on which, besides the name and the surname, the abbreviations of professional and academic education are stated as well as the branch of the basic specialization.

The veterinarian having a private business should also have a stamp indicating the title of his practice besides the mentioned in the previous paragraph.

Article 73.

Veterinary organizations and the owners of private practice promote the performance of their activities in accordance with the provisions of the Bylaw from Article 34. of this Statute.

Article 74.

Veterinarians have the right and obligation to improve professionally all the time. For these purposes the Chamber:

- organizes the Committee for Professional Improvement of Veterinarians,

- adopts the programme of professional improvement,

- supervises the successfulness of professional improvement.

The status of the Committee for Professional Improvement is determined in details by the By-Law on Professional Improvement.

VII. AGENCY AND REPRESENTING THE CHAMBER

Article 75.

The Chamber is represented by the President of the Chamber who also acts as its agent. The President may also entitle somebody else to represent the Chamber.

VIII. ORGANIZATION OF THE CHAMBER

SUBSIDIARIES OF CROATIAN VETERINARY CHAMBER

Article 76.

The subsidiaries of the Chamber are founded for the territory of one or more districts and according to the need and the conditions also for other regions.

A subsidiary is a constitutive part of the Chamber, having a role of carrying out the jobs, promoting and adjusting the common interests of the members of the Chamber in its territory observing the Statute and the guidelines of the Chamber’s bodies.

Article 77.

The subsidiaries have their name, which is added to the name of the Chamber: Croatian Veterinary Chamber - Subsidiary ..... .

A subsidiary has its own stamp.

Article 78.

The founding and organization of the subsidiary depend on the conditions and needs of the district or other circumstances.

Article 79.

The subsidiary is managed by a Board of five members. They elect the president among themselves. The mandate of the Board’s members lasts four years.

The members of the Board act voluntarily.

Article 80.

The subsidiary acts within the limits of its means, rights, obligations and responsabilities, on the basis of this Statute and on the basis of authorization given by the Chamber’s bodies.

The subsidiary enacts the rules on its work in accordance with this Statute and the By-Law on Founding and Work of the Subsidiaries.

PROFESSIONAL DEPARTMENTS

Article 81.

Professional departments are founded for particular professional or scientific branches and disciplines. The activities and work of a professional department should be in accordance with the tasks of the Chamber.

Article 82.

The departments work independently.

A department has its By-Law on Work by which organization, the ways of electing the members and other matters from the sphere of its action are regulated.

The professional departments are established by the Chamber’s Assembly on the proposal of the Executive Committee.

IX. GENERAL DOCUMENTS OF THE CHAMBER

Article 83.

The Statute of the Chamber is a fundamental document and all other documents of the Chamber should be in accordance with the Statute. The provisions being in contradiction with the Statute of Croatian Veterinary Chamber are invalid.

Article 84.

The documents of the Chamber are as follows:

- the Statute of Croatian Veterinary Chamber,

- the Codex of Veterinary Ethics,

- the By-Law on Promoting and the Ways of Advertising the Work of Veterinary Organizations and Private Practice,

- the By-Law on the Work of Veterinarians in Private Practice,

- the By-Law on the Work of Disciplinary Board,

- the By-Law on Professional Improvement of Veterinarians Regarding the Licence Prolongation,

- the By-Law on Economic and Financial Operations of the Chamber,

- the By-Law on the Work of the Chamber’s Bodies,

- the By-Law on Rewards and Acknowledgements,

- the By-Law on Publishing Activities,

- the By-Law on the Work of Subsidiaries,

- the By-Law on the Work of Professional Departments,

- the By-Law on the Work of Professional Service,

- other bylaws, rule books and documents.

Article 85.

The general documents are signed by the president of the body which passed the document.

Article 86.

The initiative for passing the Statute and its changes may be given by the Executive Committee, Supervisory Board or the subsidiary of the Chamber.

The initiative is submitted to the Executive Committee which appoints the Commission for making the draft of the Statute and its changes, respectively, specifies the way of conducting the public discussion and its duration.

X. PROFESSIONAL SERVICE OF THE CHAMBER

Article 87.

For carrying out professional, administrative, material-financial, auxiliary and other jobs the Chamber has a professional service with the adequate number of employees.

The Executive Committee employs the workers in the professional service for a definite or indefinite time.

Article 88.

The manager of the Professional Service is the Secretary of the Chamber.

The Secretary organizes and adjusts the work of the Chamber’s bodies within the limits of its authorization, carries out other jobs and tasks being authorized for by the Chamber’s bodies.

The Executive Committee elects and appoints the Secretary on the basis of an open competition and signs with him a contract of employment.

Article 89.

The sphere of action, rights and liabilities of the Professional Service are governed by the By-Law passed by the Executive Committee.

XI. TRANSITIVE AND FINAL CLAUSES

Article 90.

The competent committees are obliged to adjust the present documents of the Chamber in three months time from the day of their becoming effective.

Article 91.

The Executive Committee is entitled for interpretation of this Statute.

Article 92.

According to Article 105., item 5 of the Act on Veterinary Service (National Gazette, no. 70/97) the concord to this Statute is given by the Minister of Agriculture and Forestry.

This Statute becomes effective and is to be applied from the day of its passing.

Becoming effective this Statute invalidates the Statute of Croatian Veterinary Chamber from 2nd April 1993 published on 6th April 1993.
